RIGHTS REQUEST – TERMS OF USE

If you’re here, it’s probably because we’ve requested additional rights in sharing and using your photo.

We regularly reach out to social media users to request additional rights to reproduce our favourite images in our emails, on our websites and elsewhere. Whenever possible, we also include your handle or byline.

Thank you for considering this request. It is entirely your choice whether to share or not, but we think people will love your post!

By responding to our request with the hashtag YesYouCanberra you agree to the following:

  • You own all content and information you post or share with us by tagging #Floriade and #NightFest, such as posting or sharing comments, photos, and videos (referred to as “User Content”).
  • You grant to Events ACT and other ACT Government agencies a license to reproduce, display, perform, distribute, create derivative works from and otherwise use your User Content for destination marketing purposes, including without limitation on websites, email, printed publications and other marketing materials.
  • We may manipulate your User Content, including cropping and editing.
  • We may display advertisements in connection with your User Content or on pages where your User Content may be viewed by you or others.
  • We may redistribute your User Content to third parties such as industry partners and media outlets via our online image library.
  • Our license to your User Content is non-exclusive, meaning you may use the User Content for your own purposes or let others use your User Content for their purposes.
  • Our license to your User Content is royalty free, meaning we do not owe you anything else in connection with our use of your User Content.
  • We may exercise our rights anywhere in the world
  • Finally, our license is perpetual, meaning that our license lasts for an indefinite period of time.

You promise that:

  • You own all rights to your User Content or, alternatively, that you have the right to grant Floriade the rights described above.
  • Your User Content does not infringe the intellectual property rights, privacy rights, publicity rights, or other legal rights of any third party.
  • You have the approval of all person/persons depicted in the User Content for Floriade and associated third parties to distribute and use across marketing materials.
  • We may refuse to accept or transmit User Content for any reason. We may remove User Content from our channels for any reason.

COPYRIGHT AND INTELLECTUAL PROPERTY

If you believe that a user has infringed on your intellectual property rights, or if we have taken down your materials due to suspicion of copyright infringement, and you would like to dispute the alleged infringement, please contact us.

PRIVACY

When your User Content is displayed as detailed above, your social media handle may be displayed as detailed above. Floriade collects and processes this information as necessary for the performance of this contract between us. We work with a service provider to help us review, gather, and display your User Content. #FLORIADE and #NIGHTFEST ON SOCIAL MEDIA

Floriade and NightFest are fortunate to have a number of passionate fans and advocates who want to help us spread the word about our wonderful part of the world.

We feature the best photos and videos shared by our fans using #Floriade and #NightFest across our website, Facebook and Instagram on an ongoing basis. Read on for some examples of the types of content we know work really well on our channels, and some tips on how you can be featured.

WHAT WORKS

We post images from fans and industry throughout the week, focusing on colourful, bright images that showcase how Canberrans connect with Floriade. We love featuring the diversity of experiences on offer from workshops through to the tulip trail and marketplace goodies.

There are also some things that we won’t post:

Anything that violates Instagram’s community guidelines or , you know, the law.

  • Black and white imagery – as we love showing off our colourful event.
  • Collages – if you’ve got too many great Instagram pics to share, try sharing a post with multiple photos.
  • Watermarked images – we will always credit you in our captions and may contact you for a non-watermarked image if we’re absolutely smitten with your photo or would like more information.
  • Anything overtly commercial, including graphics with lots of text, or brand logos.

HOW TO GET FEATURED

Tips for getting featured across Floriade’s digital channels

  • The more information you give us when sharing a photo or video, the more likely we are to be able to feature you. This type of information can include:
  • Specific locations where you captured your spectacular Floriade or NightFest shot.
  • If you’re a wizard with Photoshop or have done something tricky with overlays and the like – we’ll be impressed, but we’d also like to know so that we don’t stress out any budding photographers thinking that the standard’s been set too high.
  • If you’ve written a great blog on Floriade: Reimagined, NightFest or Canberra that you think we might be interested in, feel free to message us or tag our page on Facebook, or message us on Instagram.

Here’s some channel specific information that’s good for you to know:

Facebook

  • Upload your photos and videos from your business page to Floriade’s Facebook.
  • Seen a post from us or someone on our wall that’s relevant to what you do? Jump in and participate in conversations.

Instagram

  • Use #Floriade and #NightFest in your Instagram captions for us to check it out – it also lets us know that you’re a-ok with us reposting! This is the first and best way to get our attention, but we’ll also monitor photos that we’re tagged in or those that use our handle in the caption – just not as often.
  • We love great captions that tell a story about your Floriade: Reimagined and NightFest experience and like to include them along with your photo too, if they’re relevant.
  • We think Instagram Stories are a lot of fun. Tag our account with @floriade_australia – we love to interact with you and see your Canberra adventures as they happen. Please note that Stories only last 24 hours, so if you’re posting over the weekend, we might not catch it in time.
  • If you’ve got any questions or want to let us know about something you think we’d be interested in, feel free to shoot us a direct message.

Website

  • We may curate images to be featured on our website from the #Floriade and #NightFest hashtag.

COMMUNITY GUIDELINES

Floriade encourages intelligent conversation and welcomes questions, comments and debate on its social media platforms.

As an organisation that supports many industries and community groups we focus on constructive contributions, and will not provide a forum for trolling, abuse or personal attacks of any kind.

We value people’s opinions but will distinguish between comments that contain constructive, relevant arguments and those that are abusive, offensive or could be construed as an attack.

We expect people making comments to consider the impact of their words and take responsibility for them. If we decide a comment is not in keeping with the spirit of this policy, we will remove it. We will also remove slanderous and defamatory comments, and those that may breach copyright.

This guide is not designed to stop people discussing things they’re passionate about. It is a reminder to think about how you express your views, and to be aware that some people may misunderstand you.
